Ken Diamondstone Stays on Ballot: Another Setback for Marty Connor

The race for the 25th State Senate district continues. Marty Connor's court challenge to Ken Diamondstone's candidacy has failed. Daimondstone's press release is at the bottom.

This race is an odd one. Marty Connor is a long time incumbent, yet his fundraising is abyssmal and he has misspent a large chunk of that money dubiously. Mostly they don't differ on the issues much, both being quite liberal. Diamondstone focuses more on Brooklyn, hence has taken a strong stand against the destruction of Brooklyn as a unique community by Ratner. Connor focuses more on Manhattan and has said he doesn't care about Ratner's plan. That seems to be their main issue difference. The other difference is style. Connor's style is often uninterested unless challenged, at which time he gets nasty. Diamondstone seems to perpetuatly tilt at windmills quite aggressively. Both can get nasty but Diamondstone is more articulate as to why he is angry while Connor exudes a sense of entitlement to his anger.

I have resisted taking a side here simply because my main impression is a dislike of Connor after his nastiness at IND meetings. My main impression has been of Diamondstone standing up to the machine at a County Committee meeting. This has left me favoring Diamondstone. But I also know Connor was instrumental in Margarita-Lopez's victory, so that is a point in his favor. Ultimately I do not know which is the better candidate, but I do know that Connor's style and lack of interest in defending our community against Ratner's corruption has left me unable to support him.

What follows is Diamondstone's statement:

AUGUST 11, 2006, BROOKLYN, NEW YORK - The New York State Supreme Court ruled today that Ken Diamondstone, candidate for the 25th state senate district, is legally eligible to appear on the ballot as a candidate in the primary and general elections. Diamondstone had been challenged by his opponent Martin Connor, not on the issues and needs of the constituents, but rather by trying to limit Diamondstone's access to the ballot through legal action.

"My opponent's attempt to block my access to the ballot was an act of desperation," said Diamondstone. "The court decision proves that this type of action is not only unethical and undemocratic, but that, ultimately, the Board of Elections overstepped their bounds in removing me from the ballot. This entire process was a tremendous waste of time, money and resources and a perfect example of why we need immediate reform in Albany."

This action was business as usual for Martin Connor and is another installment in a long line of unethical and undemocratic actions that prove he is part of the problem in Albany. From misusing campaign funds to buy a car, to making a living on a legal practice devoted to knocking candidates off the ballot, Connor represents the worst of what is wrong in Albany.

Diamondstone proved in court that he moved into the district before the legal deadline of November 7, 2003 through testimony and evidence such as a lease signed for November 1, 2003 and a receipt from Ken's landlord showing payment for the apartment for the same date.

Diamondstone continued, "The 25th district deserves a state senator who is committed to reform in Albany--no one should have to go through what I did simply to gain access to the ballot. This election is a clear indication of the dire need for campaign and election reform to ensure that campaigns are about new ideas to improve our community. These reforms should include independent commissions for redistricting, campaign finance reform, and a fair process for access to the ballot."

"I expect Senator Connor to honor the ruling and join me in a race that engages the community. This election should be judged in the court of public opinion. I plan to refocus all my energies to a campaign based on the issues."

The district is 70% in

The district is 70% in Manhattan, so it only seems right for 2/3rds of whoever wins focus to be on Manhattan. Frankly, Ken seems disinterested in Manhattan, which, given that it's mostly the Lower East Side, is a much poorer community, much more in need of attention. The Brooklyn portion of the district doesn't even come that near Atlantic Yards, and there are actually issues of more concern that both candidates should be focussing on like the development of the Gowanus Canal area.

You contradict yourself

What is the greatest new threat to the Gowanus? Seweage from the Atlatic Yards project. Increased sewage will create more sewage back ups dowstream...which ultimately means people's homes and the canal.

I agree Diamondstone has mainly focused to date on Brooklyn (and Marty on Manhattan). But Ken does focus on other issues than just the Ratner problem (including judicial nominees, local machine corruption, etc). Furthermore, the Ratner problem involves issues of large-scale corruption that should be of interest to all of Albany and involves infrastructure problems that will impact all of Brooklyn and the project itself would, in the words of Schiffman, "permanently scar Brooklyn." So Connor's complete and actually rudely put lack of interest is plain dumb. And, as I have said elsehwere, Joan Millman was critical of Connors' lack of interest because of the fact that the Ratner problem will negatively impact all of Brooklyn, making it EVERYONE's issue.

Now here I am defending Ken again. I have to say I am ambivalent here. My distaste regarding Connor's attitude towards people leans me towards Ken. But both have negatives and both have positives. I should write a larger piece on this but haven't gotten around to it...and since it isn't my district it hasn't seemed a priority. SD-25 and CD-10 are districts I am glad not to be in: it would be hard to know where to cast my vote.

The argument against Connor

The argument against Connor is that he's been in his seat so long that he may have lost his effectiveness. He has already lost his leadership post and hasn't accomplished mucb in recent years that I can tell. The legislature is full of folks that have been in Albany way too long and get re-elected so routinely that they either no longer need have to try to do too much in office or, like Joe Bruno, become so entrenched and powerful that they no longer need have to answer to their constituents. There badly needs to be a movement towards term limits in the assembly and senate. Connor's had the seat for something like twenty five years, he has gotten old and complacent. It is time for new blood, Connor should give somebody else a chance at the seat. Change is good. He shouldn't try to kick other guys off the ballot, as if he views his seat as a lifetime appointment that he gets to keep until he dies, retires or doesn't want the paycheck anymore.

Marty Connor deserves no points

Mole 333 says, "But I also know Connor was instrumental in Margarita-Lopez's victory, so that is a point in his favor" Well, my friend, you can discount that point. First of all, Marty did NOTHING for Margarita Lopez-Torres that he wasn't PAID to do, quite handsomely. Second, it was an army of volunteers, most notably including Ken Diamondstaone, who did the day-in, day-out grunt work of looking up voting records at the Board of Elections. Third, as court watchers may have noted during the courtroom proceedings this past week, Marty is a has-been as an election lawyer. He (and Henry Berger) may have been on the top of that odious pile of sleezy lawyers specializing in getting the perenially incompetent Board of Elections to rule favorably for their clients, but he doesn't seem to know election law all that well. Bullies like Marty would vanish in a flash if the Board of Elections were ever cleaned up. Let's flush Marty down the drain and start to clean up Albany!

Connor got paid?

I'm reminded of the scene in Casablanca where Claude Rains confronts Bogie about his working for Ethopia and the Spansh Loyalists. Bogie says "I was well paid both times". And Rains replies "the other side would have paid more".
You can't wish away Connor's work for Lopez-Torres so easily.

I still hold it as a point in his favor. But she is right in that Ken also gets a point in his favor for the help he gave Margarita Lopez.

Connor is not giving up

Connor is now appealing the court decision letting Diamondstone back on the ballot. He is trying to tie Ken up in court so he can't campaign and has to spend all his money on lawyers. This makes little sense as Connor is likely to win reelection easily anyway. Does he have a personal grudge against Diamondstone or something?

Possibly nervous

I'd still lay money on Connor, but Diamondstone has out raised Connor and has loaned his campaign tons of money, so Diamondstone is way ahead with money. Connor had little more than debt and it was THEN that Connor started the lawsuits, right or wrong.

Connor has a grudge against anyone who doesn't say "yes" to him. I've seen his nastiness when he doesn't get his way.

Having watched over the

Having watched over the years, I can verify that Connor has a grudge against Ken for the reason that Ken has a grudge agsinst him. Ken admitted under oath he moved to Brooklyn Heights for the sole purpose of running against Connor. In fact, he admitted that he intended to run in 2004, but learned of the residency requirement too late from a sneering Connor supporter who laughed at him, which seem to have caused a high level of fury. Ken is just obsessed with Marty for reasons which seem to go way beyond the few issues upon which they may differ. Ken lives to run against Connor; in fact, I suspect that if Connor had not run, Ken would have been extremely depressed.
